Please read these Terms of Service ("Terms") carefully before using the website located at ritual-customs.com (the "Site") or purchasing any products from Ritual Custom Woodworks ("we," "us," or "our"), operated by [OWNER FULL NAME], a [STATE] limited liability company.

1. Acceptance of Terms

By accessing the Site or placing an order, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Site or place an order. You must be at least 18 years of age to make a purchase. By placing an order, you represent that you are 18 or older.

2. Our Products

All products sold through this Site are handcrafted, one-of-a-kind pieces made by hand using traditional woodworking techniques. As a result:

  • Each piece is unique. Product photographs show the exact item for sale. Minor natural variations in wood grain, color, figure, and finish are inherent to handmade goods and are not defects.
  • Product photography is taken under controlled lighting. Actual color may vary slightly depending on your monitor settings and the wood's natural variation.
  • Once a piece is marked "Sold," it is no longer available. We do not offer reproductions of sold pieces unless specifically offered as a commission.
  • Prices are listed in US dollars (USD). We reserve the right to change prices at any time. Your price is locked in at the time of purchase.

3. Orders & Payment

Payment Processing

All payments are processed securely by PayPal. We do not collect, store, or process payment card information on our servers. By completing a purchase, you also agree to PayPal's Terms of Service and Privacy Policy. We accept payment methods supported by PayPal including major credit and debit cards.

Order Confirmation

A purchase is complete when PayPal confirms your payment. You will receive a confirmation email from PayPal. We will ship your order within [X business days] of payment confirmation, subject to our Shipping Policy.

Pricing & Taxes

Product prices do not include applicable sales tax, GST/HST, or import duties. Tax will be calculated and collected as required by applicable law. International customers are responsible for all customs duties, import taxes, and brokerage fees assessed by their country's customs authority. See our Shipping Policy for details.

Cancellations

Orders may be cancelled before shipment by contacting us immediately. Once an item has shipped, our Return Policy applies. Custom/commissioned orders cannot be cancelled once materials have been sourced or work has begun β€” see Section 4.

Discount Codes

Discount codes are issued at our discretion. They are valid for one-time use unless otherwise stated, cannot be combined with other offers, have no cash value, and expire as indicated. We reserve the right to cancel or expire discount codes at any time.

4. Custom & Commissioned Orders

Custom and commissioned pieces are subject to the following additional terms:

  • Deposit: A non-refundable deposit of [X%] of the agreed price is required to begin work. The deposit covers design consultation, material sourcing, and initial labor.
  • Changes: Material changes to the agreed design after work has begun may result in additional charges. All changes must be agreed in writing (email is acceptable).
  • Cancellation: If you cancel after the deposit is paid and materials have been ordered or work has begun, the deposit is forfeited. If we are unable to complete your commission, we will refund your deposit in full.
  • Timeline: Estimated completion timelines are provided in good faith but may vary due to the nature of handcraft and material availability. We will notify you of significant delays.
  • Natural variation: Custom pieces using natural wood materials will exhibit unique grain, color, and figuring that may differ from reference images. These natural characteristics are features, not defects.

5. Intellectual Property

Our Content

All content on this Site β€” including photographs, text, logos, designs, and the Site's look and feel β€” is the intellectual property of Ritual Custom Woodworks or its licensors and is protected by US copyright law and international treaties. You may not reproduce, distribute, or create derivative works without our express written permission.

Custom Order IP

Unless explicitly agreed otherwise in writing, Ritual Custom Woodworks retains all intellectual property rights in the design of custom and commissioned pieces. We retain the right to photograph completed pieces and use those photographs for portfolio, marketing, and social media purposes. The physical piece is yours; the design and photographs belong to us.

6. Prohibited Uses

You agree not to use the Site to:

  • Violate any applicable local, state, federal, or international law or regulation.
  • Engage in fraudulent activity, including submitting false orders or chargeback abuse.
  • Attempt to gain unauthorized access to any part of the Site or its underlying systems.
  • Scrape, harvest, or collect data from the Site by automated means.
  • Transmit spam, malware, or other harmful code.
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity.

7. Disclaimers

THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, EXCEPT AS REQUIRED BY APPLICABLE LAW. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Site will be uninterrupted, error-free, or free of viruses. Product descriptions and photographs are as accurate as possible, but we do not warrant that descriptions are error-free.

Note for consumers in Quebec: Nothing in these Terms limits or excludes any rights you have under the Quebec Consumer Protection Act, including the legal warranty (garantie lΓ©gale) against latent defects.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL RITUAL CUSTOM WOODWORKS, ITS OWNER, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR YOUR PURCHASE OF OUR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR YOUR PURCHASE SHALL NOT EXCEED THE PURCHASE PRICE YOU PAID FOR THE SPECIFIC PRODUCT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

9. Indemnification

You agree to indemnify and hold harmless Ritual Custom Woodworks and its owner from and against any claims, liabilities, damages, judgments, and expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or your use of the Site.

10. Governing Law & Disputes

These Terms are governed by the laws of the State of [STATE], without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Site shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in [CITY, STATE] under the rules of the American Arbitration Association (AAA), except that either party may seek relief in small claims court for disputes within that court's jurisdiction.

Class action waiver: You agree that any dispute resolution will be conducted on an individual basis only and not as a class action, consolidated action, or representative action.

Canadian and EU consumers: Nothing in this section limits your right to pursue remedies in your local courts or before your local consumer protection authority as provided by applicable mandatory law in your jurisdiction.

11. Changes to These Terms

We reserve the right to update these Terms at any time. Changes take effect when posted to the Site with an updated effective date. Your continued use of the Site after changes are posted constitutes acceptance of the new Terms. We encourage you to review these Terms periodically.
